The Terms and Conditions contain important information for you as a customer. Please read them carefully. We recommend that you save or print these Terms and Conditions so that you can refer to them again at a later time.

Article 1. Definitions

1.1. Yventa: established in Pijnacker and registered with the Dutch Chamber of Commerce under registration number 99452839, trading under the name Yventa.

1.2. Website: the Yventa website, accessible via www.yventa.nl, including all associated subdomains.

1.3. Customer: a natural person who is not acting in the course of a profession or business and who enters into an Agreement with Yventa and/or has registered on the Website.

1.4. Agreement: any arrangement or agreement between Yventa and the Customer, of which these Terms and Conditions form an integral part.

1.5. Terms and Conditions: these Terms and Conditions.

Article 2. Applicability of the Terms and Conditions

2.1. These Terms and Conditions apply to all offers, Agreements and deliveries by Yventa, unless expressly agreed otherwise in writing.

2.2. If, in its order, confirmation or other communication, the Customer includes provisions or conditions that differ from or are not included in these Terms and Conditions, these shall be binding on Yventa only if and to the extent that Yventa has expressly accepted them in writing.

2.3. If, in addition to these Terms and Conditions, specific product or service terms apply, those terms shall also apply. However, in the event of conflicting provisions, the Customer may always rely on the provision that is most favorable to them.

Article 3. Prices and Information

3.1. All prices stated on the Website and in other materials originating from Yventa include VAT, unless otherwise stated on the Website, as well as any other government-imposed levies.

3.2. If shipping costs are charged, these costs will be displayed separately during the ordering process.

3.3. The content of the Website has been compiled with the utmost care. However, Yventa cannot guarantee that all information on the Website is accurate and complete at all times. All prices and other information on the Website and in other materials originating from Yventa are therefore subject to obvious programming and typographical errors.

3.4. Yventa cannot be held responsible for colour deviations resulting from differences in screen quality.

Article 4. Formation of the Agreement

4.1. The Agreement is concluded at the moment the Customer accepts Yventa’s offer and fulfils the conditions set by Yventa in connection with that offer.

4.2. If the Customer has accepted the offer electronically, Yventa will promptly confirm receipt of the acceptance of the offer electronically. Until receipt of this acceptance has been confirmed, the Customer may terminate the Agreement.

4.3. If it becomes apparent that the Customer has provided incorrect information when accepting the offer or otherwise entering into the Agreement, Yventa has the right to fulfil its obligations only after the correct information has been received.

4.4. Within the limits of applicable law, Yventa may ascertain whether the Customer is able to meet their payment obligations, as well as consider any facts and circumstances relevant to the proper conclusion of the Agreement. If, based on this investigation, Yventa has good reason not to enter into the Agreement, Yventa is entitled to refuse an order or request with reasons, or to attach special conditions to its performance, such as requiring advance payment.

Article 5. Registration

5.1. In order to make optimal use of the Website, the Customer may register via the registration form or account registration option on the Website.

5.2. During the registration process, the Customer chooses a username and password with which they can log in to the Website after registration. The Customer is solely responsible for choosing a sufficiently secure password.

5.3. The Customer must keep their login details, username and password strictly confidential. Yventa is not liable for any misuse of the login details and may assume at all times that the Customer who logs in to the Website is actually the Customer. Anything that occurs through the Customer's account falls under the Customer's responsibility and risk.

5.4. If the Customer knows or suspects that their login details have fallen into the hands of unauthorised persons, they must change their password as soon as possible and/or notify Yventa, so that Yventa can take appropriate measures.

Article 6. Performance of the Agreement

6.1. Once Yventa has received the order, Yventa will ship the products as soon as possible, taking into account the provisions set out in Article 3.

6.2. Yventa is entitled to engage third parties in the performance of its obligations arising from the Agreement.

6.3. The delivery period is generally 2–3 business days. Delivery may take place in various ways, at Yventa’s discretion.

6.4. If Yventa is unable to deliver the products within the agreed delivery period, it will notify the Customer accordingly. In that case, the Customer may agree to a new delivery date or may terminate the Agreement free of charge.

6.5. Yventa advises the Customer to inspect the delivered products and to report any defects identified within a reasonable period of time, preferably in writing. Please refer to the Article concerning warranty and conformity for further details.

6.6. Once the products to be delivered have been delivered to the specified delivery address, the risk relating to these products passes to the Customer. If expressly agreed otherwise, the risk passes to the Customer at an earlier time. If the Customer chooses to collect the products, the risk passes to the Customer upon collection.

6.7. Yventa is entitled to supply a similar product of similar quality instead of the ordered product if the ordered product is no longer available. In that case, the Customer is entitled to terminate the Agreement free of charge and return the product free of charge.

Article 7. Right of Withdrawal

7.1. This Article applies only to Customers who are natural persons and who are not acting in the course of their profession or business.

7.2. The Customer has the right to terminate the distance contract with Yventa within 14 days of receiving the product, without giving any reason and free of charge.

7.3. The withdrawal period begins on the day after the Customer, or a third party designated by the Customer who is not the carrier, has received the product, or:

  • if the Customer has ordered multiple products in the same order: the day on which the Customer, or a third party designated by the Customer, has received the last product;
  • if the delivery of a product consists of several shipments or parts: the day on which the Customer, or a third party designated by the Customer, has received the last shipment or the last part;
  • in the case of agreements for the regular delivery of products over a specified period: the day on which the Customer, or a third party designated by the Customer, has received the first product.

7.4. The Customer is responsible for the return shipping costs. The shipping costs incurred by the Customer when purchasing the product are not included in the return costs and remain the responsibility of the Customer.

7.5. During the withdrawal period referred to in paragraph 2, the Customer shall handle the product and its packaging with due care. The Customer shall only open the packaging and use the product to the extent necessary to determine the nature, characteristics and functioning of the product. The guiding principle is that this inspection may not go beyond what the Customer would reasonably be permitted to do in a physical store.

7.6. The Customer is only liable for any reduction in the value of the product resulting from handling the product beyond what is permitted under the previous paragraph.

7.7. The Customer may terminate the Agreement within the period specified in paragraph 2 of this Article by sending Yventa the model withdrawal form (digitally), or by providing Yventa with another unambiguous statement of their decision to withdraw from the Agreement. Yventa will confirm receipt of a digital notification of withdrawal. Following termination, the Customer has a further 14 days to return the product. It is also possible to return the product immediately within the withdrawal period referred to in paragraph 2 of this Article, provided that the model withdrawal form or another unambiguous statement of withdrawal is enclosed with the returned product.

Products can be returned to:

Yventa
PRIPAR00045761
Weteringweg 18
2641 KM Pijnacker
The Netherlands

7.8. Any amounts already paid by the Customer (in advance) will be refunded as soon as possible, but no later than 14 days after termination of the Agreement, using the same payment method as the Customer used to pay for the order. If the Customer has chosen a more expensive delivery method than the least expensive standard delivery method, the additional costs for the more expensive delivery method will not be refunded, unless Yventa offers to collect the product itself. Yventa may wait with the refund until it has received the product or until the Customer demonstrates that the product has been returned, whichever occurs first.

7.9. The Website will clearly and promptly state, before the Agreement is concluded, information about whether or not the right of withdrawal applies and, where applicable, the procedure to be followed.

Article 8. Payment

8.1. The Customer shall make payments to Yventa using the payment methods indicated during the ordering process and, where applicable, on the Website. Yventa is free to choose which payment methods it offers and may change these from time to time. In the case of payment upon delivery, the Customer has a payment period of 14 days, commencing on the day after delivery.

Article 9. Warranty and Conformity

9.1. This Article applies only if the Customer is not acting in the course of their profession or business. If Yventa provides a separate warranty for the products, this warranty shall apply to all types of Customers, notwithstanding the above.

9.2. Yventa warrants that the products comply with the Agreement, the specifications stated in the offer, reasonable requirements of soundness and usability, and the legal provisions and/or government regulations applicable on the date on which the Agreement was concluded.

9.3. Any warranty provided by Yventa, the manufacturer or the importer does not affect the statutory rights and claims that the Customer has and may exercise under the Agreement.

9.4. If the delivered product does not comply with the Agreement, the Customer must notify Yventa of this within a reasonable period after discovering the defect.

9.5. If Yventa considers the complaint justified, after consultation with the Customer, Yventa will repair, replace or refund the relevant products. The maximum compensation, taking into account the Article concerning liability, is limited to the price paid by the Customer for the product.

Article 10. Complaints Procedure

10.1. If the Customer has a complaint about a product (in accordance with the Article concerning warranty and conformity) and/or about other aspects of Yventa’s services, the Customer may submit a complaint to Yventa by email. Please refer to the contact details at the end of these Terms and Conditions.

10.2. Yventa will respond to the Customer’s complaint as soon as possible, but in any event within 3 days of receiving the complaint. If it is not yet possible to provide a substantive response within this period, Yventa will confirm receipt of the complaint within 3 days and provide an indication of the timeframe within which the Customer can expect a substantive response.

10.3. A Customer who is not acting in the course of their profession or business may also submit a complaint through an appropriate alternative dispute resolution body.

Article 11. Personal Data

11.1. Yventa processes the Customer’s personal data in accordance with the privacy statement published on the Website.

Article 12. Final Provisions

12.1. The Agreement shall be governed by Dutch law.

12.2. Unless mandatory legal provisions provide otherwise, all disputes that may arise in connection with the Agreement shall be submitted to the competent court in the district where Yventa is established.

12.3. If any provision of these Terms and Conditions is found to be invalid, this shall not affect the validity of the Terms and Conditions as a whole. In such a case, the parties shall establish a replacement provision that, to the greatest extent possible, gives effect to the purpose of the original provision.

12.4. In these Terms and Conditions, “in writing” shall also mean communication by email, provided that the identity of the sender and the integrity of the email can be sufficiently established.

12.5 These general terms and conditions have been drawn up in both the Dutch and the English language. In the event of a conflict, inconsistency, or discrepancy between the Dutch text and the English translation thereof, the Dutch text shall prevail."
